2. Scope

These terms and conditions of sale apply to all orders placed with Atelier CAL through the website or a secure payment link.

The products offered are primarily intended for professional use (B2B). The buyer acknowledges acting in the course of their professional activity and having the skills required to use professional confectionery equipment.

3. Products

Atelier CAL designs and sells professional confectionery machines and rollers, made to order or in limited production runs.

Images, 3D renderings, descriptions and specifications are provided for guidance. Slight technical or visual variations may occur without affecting product conformity.

4. Orders and pre-orders

Some orders are placed as pre-orders and require a manufacturing lead time. All orders become firm and final once full or partial payment has been validated.

5. Prices and payment

Prices are stated in euros (€), excluding VAT. VAT is subject to the rules in force in the destination country.

For deliveries in France, payment is by bank transfer only. For other destinations, payment terms are specified in the quote; payment through Stripe is possible when a link is provided. If a deposit is paid, the remaining balance must be settled before dispatch.

6. Manufacturing lead times

Manufacturing lead times are indicative. Slight delays may occur, particularly due to production, supply or logistics constraints. Atelier CAL undertakes to inform the customer as soon as possible in the event of a delay.

No delay shall entitle the buyer to cancel the order, impose a penalty or claim compensation.

7. Delivery

Shipping is handled by a professional carrier (FedEx). Goods are generally dispatched within 48 hours after the machine is ready to ship.

Shipments are insured against theft and damage in transit. Delivery times are indicative and depend solely on the carrier.

8. Receipt, inspection and damage

On receipt, the customer must check the condition of the package and the machine. Any damage, impact, deterioration or anomaly must be recorded in precise, detailed reservations with the carrier, and Atelier CAL must be informed immediately, no later than 24 hours after receipt.

Without reservations or notification within these time limits, no claim can be accepted.

9. Liability

Atelier CAL machines are professional equipment. Atelier CAL cannot be held liable for misuse, failure to follow safety instructions, use by an untrained operator or indirect losses such as business interruption, production losses or financial losses.

The user remains solely responsible for operating the machine.

10. Warranty

The machines carry a warranty covering manufacturing defects, excluding normal wear, misuse, unauthorised modifications or repairs, and failure to follow the operating instructions.

All warranty claims must be made in writing and accompanied by supporting evidence.

11. Right of withdrawal

Under Article L221-28 of the French Consumer Code, products made to measure, made to order or pre-ordered are not covered by the right of withdrawal.

12. Intellectual property – INPI protection

The machines, rollers, engravings, designs, models, images, 3D renderings, plans and concepts developed by Atelier CAL are protected by intellectual property law. Some elements are registered and protected with the French INPI.

Any reproduction, copying, modification, distribution or exploitation, in whole or in part, without prior written permission from Atelier CAL is strictly prohibited and may result in legal proceedings.

13. Personal data

The data collected is used exclusively to process orders and manage customer relations. It is neither sold nor transferred to third parties.

14. Applicable law and jurisdiction

These terms and conditions are governed by French law. In the event of a dispute, the parties undertake to seek an amicable solution before taking legal action. Failing this, the French courts shall have exclusive jurisdiction.
